PELAKSANAAN FUNGSI BADAN KEHORMATAN DALAM MENEGAKKAN PERATURAN TATA TERTIB KAITANNYA DENGAN KODE ETIK DEWAN PERWAKILAN RAKYAT DAERAH PROVINSI SUMATERA UTARA

Abstract

The purpose of the study is to investigate the implementation of the function of the Honorary Board in enforcing the terms of the Rules of Procedure Code and the North Sumatra Provincial Parliament to determine the obstacles faced by the Ethics Council in upholding the Rules of Procedure Code relation to the North Sumatra Provincial Parliament and its solutions. Based on research conducted by the authors showed that the implementation of the Agency function in upholding the honor of the Rules of Procedure orderly relation to the Code of North Sumatra Provincial Parliament by basing on the Rules of Procedure and the Code of Conduct Regulation Legislative Council of North Sumatra Province. In cases of infringement, the Ethics Council has the functions, powers and duties to investigate and examine abuses, expressed consideration the results of the examination to recommend sanctions or rehabilitation of the legislators were reported. But the execution of existing sanctions on the Governing Council. Some obstacles encountered in the implementation of the Honorary Board of the Rules of Procedure enforcing functions in relation to the Code of DPRD North Sumatra Province are as follows: 1) Lack of personal and institutional support from outside the Honorary Board; 2) Lack of role of the community; 3) The absence of clear sanctions based on the legislation. As a solution to these constraints, namely: 1) Giving full support either personal or institutional support from outside the Honorary Board; 2) Increasing the role of the community; 3) It should be immediately set up clear rules on sanctions for violations committed by members of Parliament.
