Abstract

This study aims to determine the legal protection for brand holders in Indonesia. This research uses the research method of literature review (library research) that is research based on literature review and laws related to the brand. With the protection of the brand through legal instruments, both civil and criminal, is a legal consequence of a form of appreciation to the brand owner who has opened his mind and poured all his intellectual abilities, with the amount of time wasted and the cost so great, so it is not wrong if all his or her possessions are granted an exclusive right to prohibit others who without permission to create, replicate, copy, duplicate and / or distribute and trade goods or services that have been granted the right of the mark in return for their creations and efforts to obtain the name attached to the goods or services.
