Abstract

State upholding human rights, including the rights Children characterized by the guarantee of the protection and fulfillment of Child Rights in the Constitution of the Republic of Indonesia Year 1945 and some provisions of the legislation both national and international nature , This guarantee strengthened through the ratification of the international convention on the Rights of the Child, namely the ratification of the CRC through Presidential Decree No. 36 of 1990 on Ratification of the Convention On The Rights Of The Child (Convention on the Rights of the Child).
Although legal instruments have been held to protect the rights of children, namely Law - Law No. 23 of 2002 on Protection of Children, on the way to Law Number 23 Year 2002 on Child Protection has not been able to effectively, so that is still a lot going on criminal acts against children as child trafficking, child abuse, sexual crimes against children and others - others.

Cases of sexual abuse of children is one of the cases which have increased significantly in recent years. Not only increased quantitatively but also qualitatively. From time to time the amount of violence against children is unstoppable and increasingly inhumane operandinyapun mode. The quantity of sexual violence against children, lately very worrying.

The perpetrator is the main executor in case of sexual crimes on children, but that does not mean the case is solely caused by the deviant behavior of the perpetrator, but are influenced by other factors that are beyond the person of the offender. But in general it can be stated that the factors causing crimes of sexual crimes are divided into two (2) parts: a. Internal factors are factors contained in the individual. This factor specific views of the individual as well look for things that have a relationship to the crime of rape and b. External factors are factors that are beyond the person of the offender.
